Facts:
After plaintiff
licensee's third conviction of operating a motor vehicle while under the
influence of intoxicating liquor (OUI), the Massachusetts Registrar of Motor
Vehicles revoked his license to operate a motor vehicle in Massachusetts for
eight years. He appealed; the Massachusetts Board of Appeal on Motor Vehicle
Liability Policies and Bonds affirmed. He sought judicial review and moved for
judgment on the pleadings..

The Massachusetts
Court made the following holding:
- Mass. Gen. Laws ch. 90,
§24, and its neighboring sections govern the licensing consequences of
operating a motor vehicle while under the influence of an intoxicating
liquor. With certain exceptions, § 24(1)(b) requires the Massachusetts
Registrar of Motor Vehicles to revoke the driver's license of any person
who has a conviction of operating a motor vehicle while under the influence
of an intoxicating liquor (OUI) in violation of Mass. Gen. Laws ch. 90, §
24(1)(a)(1). Section 24(1)(b) does not itself specify how long a license
will be revoked. Instead, § 24(1)(c), sets forth certain time periods
during which the Registrar is prohibited from restoring a person's
license. These time periods are determined by the number of previous
convictions a person has for an OUI or a like offense. § 24(1)(c). Section
24(1)(c)(3) provides that the Registrar is prohibited from restoring a
third-time offender's license until eight years after the date of
conviction..
