Facts:
The commonwealth
sought review of a judgment of the Appeals Court (Massachusetts), which
reversed defendant's conviction in Boston for operating under the influence
(OUI) of intoxicating liquor, pursuant to Mass. Gen. Laws ch. 90, §
24(1)(a)(1), and affirmed the conviction for operating a motor vehicle
negligently so that the lives and safety of the public might have been
endangered, pursuant to Mass. Gen. Laws ch. 90, § 24(2)(a).

The Massachusetts
Court made the following holding:
- Mass. Gen. Laws ch. 90,
§ 24(1)(a)(1) (1986) provides in part: Whoever operates a motor vehicle
while under the influence of intoxicating liquor, or of marihuana,
narcotic drugs, depressants or stimulant substances, all as defined in
Mass. Gen. Laws ch. 94C, § 1, shall be punished. Mass. Gen. Laws ch. 90, §
24(1)(a)(1) (1986).
- A defendant may be found
guilty of driving while under the influence of intoxicating liquor if the
defendant's ability to operate a vehicle safely is diminished, and alcohol
is one contributing cause of the diminished ability. It is not necessary
that alcohol be the sole or exclusive cause. It is enough if the
defendant's capacity to operate a motor vehicle is diminished because of
alcohol, even though other, concurrent causes contribute to that
diminished capacity. When the defendant is charged with operating while
under the influence of intoxicating liquor, it is immaterial whether the
driver is under the influence of intoxicating liquor and other substances.
In order to find guilt, the jury needs only to find that the liquor
contributed to the defendant's impairment.
